Act of  7 July 1994 – Construction Law

 

Art. 17. In terms of the act the members of construction process are:

  • Investor,
  • Investor’s supervision Inspector,
  • Designer,
  • Construction site manager or construction manager.

Art. 18.1 It is the investor’s duty to organize the construction process, taking into consideration health and safety regulations  set forth in the provisions of law, especially providing:

  • Preparation of the construction project and, as the needs require, of other projects,
  • Taking over the construction management by construction manager,
  • Preparation of the health and safety plan,
  • Execution and acceptance of construction work,
  • In justified cases of high complexity of construction works or ground conditions, construction site supervision – by properly qualified persons .
    1. Investor may establish investor’s supervision inspector                at the construction site.
    2. Investor may oblige the designer to perform author’s supervision

Notes :

 The above mentioned provisions mean that in practice the investor is obliged to hire (disrespective of commissioning the construction works to the general constructor­ who hires a construction site manager) investor’s supervision inspectors. The function of the inspector is to provide proper control of the assigned works. The responsibility of appointing the inspectors is imposed in the construction permits decisions by territorial units and it is common to all (with the exception of small constructions such as a detached house)
